CONSERVATION COMMISSION

The meeting convened at 6:00p.m.
Brown – 24 Point Rd – Request for Certificate of Compliance
Tim Lovett recused himself from this project discussion. Ben of Berkshire Engineering was present to review the request for a certificate of compliance. A site visit was made and the Commission approved the issuance.
Weiss – Beartown Mtn Rd – RDA – construction of a single family dwelling, driveway, well and septic (D. Lynch is the project manager)
Chris Tryon of Berkshire Geo-Technologies was present to review the project details. DEP contacted the Commission regarding this submission and they are requiring a Notice of Intent. Chris argued that the area already has been altered/cleared and therefore felt an RDA would be adequate. The Commission determined that the area described on the plans submitted is an area subject to protection under the Act. Removing, filling, dredging, or altering of the area requires the filing of a Notice of Intent. There is a perennial flowing stream on the property.
Perlman – 14 Point Rd – RDA - remove invasive species by hand pulling (T. Lovett is the project manager)
Chris Tryon of Berkshire Geo-Technologies was present to review the project details. An annual project status report will be submitted to the Commission. The Commission approved the project as a N2.
Lee – 16 Point Rd – RDA – remove invasive species by hand pulling (D. Dempsey is the project manager)

For Discussion:
The Commission met with the homeowner (Mr. Dowd) of 10 Point Rd which the Commission may be issuing an Enforcement Order for with regards to cutting without permission. The homeowner had 7 trees taken down (some close to the house and some dying). The trees according to the homeowner and contractor (Mr. Kimberly) were dangerous. Dennis noted that the contractor and homeowner since being notified of the violation have been very cooperative. The homeowner is agreeable to planting replacement trees or low lying shrubs (native species) on the side but not close to the house or tall trees. The Commission will require that a replanting plan be submitted to the Commission for approval by the first of January.
Chris Tryon and Kenn Basler were present to request an Emergency Certification for a culvert replacement at the Main Rd and River Rd intersection as this culvert could collapse within 6 months. The Emergency Order was approved.
Mail was reviewed.
Minutes from 9/22/15 were approved as written.
Dominic Stucker was present to request being appointed as a Commission member. The Board will ask the Select Board to make the appointment at their next meeting.
The Commission reviewed the special permit application for 7 Seven Arts Rd and determined that the project is out of their jurisdiction.
Pat Edelstein was thanked for her dedicated commitment to all Monterey residents by the Conservation Commission.
